Jerry Roberts Fundraising Letter

It's gotta be tough when you are in a court case against Wendy McCaw. Like so many two-year olds that want whine with their cheese, McCaw seems to appeal until she gets the answer she wants. This is a money pit for Jerry Roberts and there is little reason for it other than McCaw can appeal. I want to update you on what's happened in the $25 million lawsuit filed against me by billionaire Wendy McCaw’s Ampersand Publishing, the owner of the Santa Barbara News-Press.

As you know, I resigned as editor in 2006 to protest unethical journalistic practices at the paper. For 2½ years, I have been unable to talk publicly about the litigation because it was filed as a private arbitration. But McCaw's lawyers recently took the matter public, so I can bring you up to date.

The good news is that we've won. The arbitrator has issued interim orders denying all of Ampersand’s claims against me and declaring me to be the prevailing party in the case. The bad news is that because of McCaw's unlimited resources and vindictive effort to ruin my family financially, it's not over yet. [Read More]

Roberts Gets Tentative Ruling in His Favor

A Santa Barbara judge has tentatively ruled against Wendy McCaw in her acrimonious and "take-no-prisoners" arbitration battle against former editor Jerry Roberts.

Apparently, McCaw has spent $2 mill in her recent legal battles. This is enough to keep a few non-profits in Santa Barbara going for years. The tentative ruling orders her to pay Roberts $12,153 in attorney's fees and $48,600 in arbitrator fees. Her legal team had said the arbitrator was too slow -- I've yet to hear an admission from them that they have been slow in responding to the National Labor Relations Board. What's good for the goose....

Nippers.com Comments Get Rowdy Over News-Press

Craig Smith had a small bit in one of his recent posts about discussion over at Nippers.com about the News-Press. Nipper himself actually commented on the Jerry Robert's suit against the paper:

Did you know that Jerry Roberts, the former News-Press Editor sued over the thread that was on Nippers about the News-Press issues? He believed that the "Hamburger" satire was about him (although his name was never mentioned in it) and he sued for $200,000. Interesting how the "champion of free speech" will use a legal hammer to smash anything written that could be remotely critical of him.


I doubt News-Press Editor Travis Armstrong would call Nipper tacky -- as he has accused Council Member Helene Schneider of late -- but I might when pressed.

Jerry Prevails, Wendy Stalls, Bold Prediction for 2009

A new development in the continuing saga of the News-Press Mess yesterday awarded former editor Jerry Roberts the prevailing party in a $10 million suit (which ended up only possibly covering his legal fees -- amount TBD) only to see News-Press owner Wendy McCaw counter by trying to throw out the arbitrator off the case. With some of the arbitration information only just now becoming public, The Santa Barbara Independent says the arbitrator called McCaw's legal tactics “scorched earth,” “take-no-prisoners,” and “go-for-broke.”

The News-Press apparently wrote an article about their actions but it sits behind the pay wall of their web site. Robert's attorney Andrine Smith called the article a "shoddy piece of propaganda disguised as a news story" -- no surprise to BlogaBarbara readers who have been following the News-Press Mess over the last few years.

Seen within the rather green light of this story, one has to wonder whether the recent layoffs at the News-Press are a result of not just poor business decisions, but poor past personnel decisions on the part of Ampersand Publishing.

What will be next with the pending February 29, 2009 National Labor Relations Board hearing about using temps as reporters? Coupled with a noticeable drop in advertising and editorial -- my bold prediction for 2009 is that the News-Press will be sold at a bargain.

Note at 7 AM: I edited the post due to an initial misunderstanding on my part of the award in the case....although the suit was for $10 million, Roberts will only get his attorney fees covered in an amount yet to be determined.

Mother's Day Effort Really a Retraction?

Craig Smith went to Las Vegas on Earth Day weekend and the News-Press printed their non-bylined article which smeared Jerry Roberts. I spent time relaxing with my family this weekend and honoring my mother and today the News-Press printed a retraction which may be really a very weak clarification on the smear article. Of couse, it was printed on a day which not many will read the newspaper -- which is pretty typical of McCaw and Company's damage control public relations game.

Interestingly, the News-Press denies that the article could represent an accusation of Jerry Roberts even though no other former users or people who could have had access to the computer were named in the article. Circular in logic, the retraction states that "persons" had access but does not name who those "persons" are. Why then name Roberts? Doesn't this "retraction" really just continue their smear campaign against him? If you are going to name one, who you happen to be in litigation with, you better name them all in some effort of fairness and integrity.

The piece goes on to quote Roberts' attorney in clarifying Raul Gil's declaration that at least two other editors and possibly an ex-business editor had access. No statement affirming or denying this quote was made in the piece. They are basically saying it is true by how it was written but how is a reader to know that for sure without their direct confirmation? Weak. Look for whether this was a statement verifying this point in court someday.

Finally, without mentioning their failure to interview Roberts for the article in question, they point to a police report that says Roberts "criminal attorney" (was that intentional?) told the SBPD that his client had no knowledge of the pornography. So, is the message he must be guilty if he speaks through his "criminal attorney"?

Strangely, the piece ends with an invitation to publish Mr. Robert's counsel's comments....um, why would his counsel jeopardize their arbitration by doing so? By putting the ball in Roberts' court, the News-Press first fails to acknowledge that they did not do a good job at reporting the issue in the first place and, second; that to actually publish Roberts' opinion could jeopardize his case. Where's the bias?

Roberts said he would sue for libel if there was not a retraction within thirty days -- does this suffice? I think not, you may think not -- but would it suffice in court?

News Wars Episode II: Attack of the Clones

While Craig Smith’s Blog and Independent’s Media Blog already have published their thorough and punchy accounts (with great photos at the Indy blog) of the legal hearing held earlier today and Episode I held yesterday about the latest chapter of The Mess, I offer my own unique perspectives here on Ampersand vs. City of Santa Barbara, which we all are learning really is just Wendy vs. Jerry. Ampersand is the corporate owner of the News-Press.

I had not stepped into a Santa Barbara County Superior Court room since I was once called to a jury pool in 1984. I am far more accustomed to the exposed format of the legislative side of local government, in the County Board room or the City Council Chambers, where no one would dare restrict a camera and brandishing a wireless phone for listening and texting is standard procedure during the meetings.

Against the side wall in the court room, a projection of the Judge’s rulings as a text document was shown on a large screen. Very cool to see justice edited in real time, most unlike the City Council decisions I often watch, where the staff response to Council direction is repeatedly“we’ll get back to you.” On the big screen in the court room, several quick cases were handled prior to Ampersand, as the Judge decided what, if anything, in the preliminary rulings would be changed in the final ruling. Using his own computer on the Bench with the projector showing his computer display, Judge Brown simply deleted and added text from his preliminary ruling to make it a final ruling, and then he sent it to print for the plaintiffs and defendants to pick up their justice delivered through an inkjet. Just don’t forget to save the file, Your Honor.

The rapidly deployed reports by Craig Smith and Matt Kettmann (Indy Media Blog) earlier today (02 May) tell the facts of the court hearing well, but a series of points by the Ampersand attorney, Barry Cappello, struck me as most interesting. Early in the hearing, Cappello quickly corrected (in a nice way) the Judge when Judge James W. Brown said that the computer hard disk in question was acquired as used hardware prior to anyone at News-Press having that disk in the computer (as discussed at length all over the blogs and recent news). Cappello said (I paraphrase) that the guy who sold the disk (or the whole computer?) would write a note to the court to verify that it was a new disk. That elicited zero response from the Judge, and some smirks in the audience.

In addition, Barry Cappello argued, emphatically, that one reason that Ampersand needed the original hard disks returned was that the Santa Barbara City police investigators were not using the proper software tools to find the contraband files on the disk. Cappello said the City was using MicroSoft products, but instead should have been using Apple software to find the files.

That new tidbit of software-tools-as-the-answer may have inspired an eyebrow to raise by the Judge, but both of mine were rising at that same moment from the second row. I kept thinking about the TV commercials of the frumpy PC Guy and the hip Mac Dude quipping about how Macs are better and foolproof. Apparently, a law enforcement agency would not be capable of using Apple software, even if that really were the issue. I wondered if the quest for porn had come down to a Windows vs. Macintosh question. If the police did have MacOS, would they need Tiger or Panther? Maybe the FBI will be using Linux instead?

Further in the legal hearing, a lot of the other arguments on both sides were about which computer(s) had original hard disks, what files were on those disks, and whether the “clone” of the disks was good enough to find the contraband pornography files that were really on the original disk now sequestered as evidence to a crime. Lots of talk was about clones and Clones of the hard disk, as making such a disk clone first is standard procedure for a forensic analysis of hidden files, according to the “disk cloning” entry at Wikipedia. I kept thinking about the hip Mac dude with a light sabre decapitating some battle droids.

As I started to realize that a City Transportation and Circulation Committee was more my style of government rather than a Superior Court hearing on technical nuances of computer clonal evidence under the California Public Records Act, I was jolted alert by Cappello stating that City Attorney Steve Wiley was “grandstanding” because Wiley dared to point out that the intent of Ampersand really just might be to “tarnish the reputation” of Jerry Roberts before evidence is properly analyzed for a potential criminal case regarding illegal porn. What was Wiley thinking?!

I could not ask Wiley about that, as he evaporated from the court room upon the close of the hearing, even faster than Scott Steepleton and Travis Armstrong did. I think Steepleton had to verify if the entire population of Santa Barbara County, or at least the same number of people, actually did not visit Alameda Park last year for a May Day march.

While live cameras were prohibited in the court room, plenty of pics and vid were recorded after the half-hour hearing in the dark tile hallway outside the court. From what I could hear of it in the beautiful but acoustically impaired hallway, Ampersand’s attorney Barry Cappello seemed to be trying to convince viewers of KSBY-TV6 what he could not convince Judge James W. Brown to believe. Cappello did acknowledge, though, that the disposition of the original, non clonal, hard disk would be up the Arbitrationer.

After the KSBY interview with Cappello, independent (small I) video producer Sam Tyler assertively asked Cappello about who and how the initial News-Press “article” came about with no by-line to reveal its author in that infamous smear article against Jerry Roberts, published on the front page of News-Press on Sunday, 23 April (Happy Earth Day, Jerry!). Cappello had no comments for Sam Tyler as Barry briskly left the building.

The mood in the courthouse hallway then changed. Other interviews became a klatch gathered around Dennis Merenbach, the attorney for Jerry Roberts. The tone was a bit more relaxed and jovial, or at least that is how it felt. But what do I know, as I, like most or all of everyone else there, is part of the Cabal.

Merenbach was a smooth talker, with an ancient, highly distressed leather briefcase at his feet. The newsies who had gathered around him, both pro and amateur, were highly interested in the plans by Merenbach for pursuing a libel case against Ampersand. Of course, he revealed no strategic details, but he stressed again their demand for a retraction of the hit piece against Roberts published 10 days earlier.

One snarky (that word again!) inquisitor asked Merenbach if a front-page retraction still would be acceptable, considering how the News-Press subscriptions and readership must have plummeted since the infamous anonymous article was published 10 days prior. Others in the crowd mumbled that the retraction demanded by Roberts (through his attorney) was as likely as sit-down negotiation ever happening between News-Press management and the Teamsters.

Local news media were well represented at this whole event, both during the court hearing and the public demonstration held outside in the half-hour prior, with participation by 53 people on a Wednesday morning. Besides the now-usual blogger journos, MSM included Daily Nexus, Daily Sound, Independent, Santa Maria Times, Santa Barbara Newsroom, KJEE radio, KSBY-TV, and maybe others. KEYT-TV3 was conspicuously absent, again, on covering this latest chapter of The Mess.

The KSBY story included reporter Carina Corral acting very Matt-Cotan in her mastery of her craft as their de facto Santa Barbara Bureau Chief.

Tentative Ruling Live at SBCourts.org

A faithful reader passed on a link that shows Judge James Brown is tentatively ruling against the News-Press on the hard drive (now drive(s) plural) issue. Somehow, another Apple G4 desktop computer with two hard drives; as well as an Apple G4 laptop with one drive, did not get mentioned in any of the other press to date that I have seen. Did I miss that? Why wouldn't even the News-Press have corrected that in their smear piece against Roberts? Or, do they think that is the smoking hard drive? Where are my Morleys!

Shame on Wendy Demonstration

Staged just prior to the court hearing on Wednesday -- I received the following from one of our readers:

Supporters of Jerry Roberts and everyone concerned about journalistic integrity are encouraged to gather during the half-hour prior to the court hearing (Superior Court room no. 4) at which Ampersand (the News-Press corporate owner) will ask the court for return of a computer hard disk containing porno images that could have originated by anyone. Law enforcement officials have stated that no case can be pursued because the chain of ownership for the computer hard disk is unknown.

Through a front-page article on Sunday, April 22, the Santa Barbara News-Press insinuated that illegal child pornography found on a computer once used by Jerry Roberts somehow involved him, even though the News-Press and its ownership and management knew, in statements last January if
not earlier, that others in the building had full access to the same computer for years and that the computer also was purchased used from unknown sources.

Many people believe that this so-called news article, with no author credited, was published by the News-Press to ruin Roberts’ reputation as part of a continuing lawsuit where the News-Press is suing him for $25 million. The News-Press demand for the computer hard disk, through a court action, appears simply to be a ruse and an insulting distraction because such images are illegal contraband and law enforcement authorities cannot allow them to be possessed by anyone. The FBI already is conducting an investigation, and the News-Press seems to think it would be a better detective than the Santa Barbara City Police and the Federal Bureau of Investigation.

People who wish to show their support for Roberts and the principled journalists, and who wish to condemn these latest News-Press insults, are invited to demonstrate for a half-hour Wednesday morning, starting at 0845 outside the Courthouse on Anacapa St. Show them, yet again, that the greater Santa Barbara community will not be intimidated and will Not Back Down to threats and innuendo by Ampersand and the News-Press.

Signs are encouraged to display, as easy as bringing and holding up the cover of the most recent issue of Santa Barbara Independent ( http://www.independent.com/ ).

News-Press Continues to Digg Hole

Travis Armstrong seems to have written an editorial that appeared last night on the News-Press web site and was then taken down in favor of an editorial about schools. Un-Digg-able....is he purposely taking things they print and not putting them on the web site as he figures many of us have our ways?

The editorial, entitled "White Washing Child Pornography", was time-stamped at midnight last night and laid into child pornographers -- all well and good, but as usual failed to tell the whole story. Without even commenting about the perhaps unconscious racism exhibited in the title (turn about is fair play), Armstrong made a point of saying Jerry Roberts was the last person to have the computer and failed to mention that it was a used computer, had several users before Roberts and the fact that News-Press management held the computer for a week before sending it to DriveSavers. Why is he afraid to tell the truth to his readers?

Surprisingly, he even went after the Police Department for "blowing it" but failed to mention that both they and the District Attorney's Office chose not to prosecute the matter. His inability to tell the whole story and then go after former newsroom employees for bias borders on perhaps the criminal and at least the delusional...why can't he tell the whole truth? That is all we want. Tell us what really happened and let us decide for ourselves -- stop trying to poison our perception with your reality of the truth!

In the meantime, he tries to make the victims to be the children from the images. Yes, this is true in that the very existence of these images should make us all shudder. But the victim at the forefront of this charade is Jerry Roberts -- a victim of a sinking ship called the News-Press that thinks the only way they can swim to shore is to attack innocent former employees that they used to trust implicitly. What kind of person would make such accusations and not tell us the whole truth?

The question Travis needs to answer is WHO had the computer before Roberts? Be a real journalist rather than an opportunist! Are you in so deep that you can't get out? Do you wonder if you can ever get a job in journalism again? Exactly who had the computer before Jerry Roberts and WHO had the computer before that? Inquiring minds want to know...

After Hours "Journalism"

Craig Smith reports today that the Roberts story on Sunday was snuck in after hours and after all but one copy editor had gone home for the night.

The story was literally stuck into the paper after everyone else had been sent home. Yep, the copy editors, except for one, were allowed to go home on Saturday evening, while the other was told to stay behind because there would be one more story coming. That was the Robert's smear piece. It made it into the paper virtually unchecked by any editors, which also explains why it did not make it onto the News-Press website until very late on Sunday.

Clearly, this 'staff report' was more of a 'management report' -- and is yet another example of there being no wall between the newsroom, editorial and management.

For someone whose editor goes on and on about eliminating 'bias in the newsroom', McCaw's hand print is certainly all over the front page. What was their motivation? Do they think this is a political campaign and smear tactics will work? Unfortunately for Jerry Roberts, as with negative political campaigns, the label will be associated with him because it was in the newspaper. This kind of vindictiveness at the cost of journalistic integrity will eventually come home to roost. The question is when...

A Black Day in Santa Barbara

For full video of ex-News-Press editor Jerry Roberts' press conference, see The Santa Barbara Newsroom article. Robert's wife, Linda Kiefer, should be his permanent spokesperson. In the video, the non-bylined Sunday article is described as "a black day in Santa Barbara".

As many of you probably guessed, the comment yesterday from a DriveSaver's employee was not real -- according to management at DriveSavers, who sent me an email. This is exactly why I said to take it with a grain or two of salt. Also, an anonymous commenter has been trying to push another local Blog as having the story first. Whether you are an imposter for DriveSavers or marketing another local "big-B" Blog -- put aside your quest and whatever your intentions may be...this story is too important to try to drive hits to your Blog or catch me in a liable position for your own or corporate benefit.

Ethics and morals are far more important than the story of the day -- especially when a clearly honorable man is being maligned with impunity. Take a deep breath and think about what it would be like if you were in the same position.

If you had any doubts as to Robert's role in this matter, see the video linked to above. After that, study up on what it takes to recover data from a used hard drive that is not protected by secure login, a locked door or a week at the News-Press in the hands of management. Make your own conclusions...and talk amongst yourselves.

The Glove Doesn't Fit!

With all due respect to the famous lawyer, wouldn't Johnny Cochrane say that from the grave? Today we saw a non by-lined story on the front page of the News-Press seeking ex-editor Jerry Robert's hard drive which (not even alledgedly in their report) contains 15,000 images of pornography. Here are the facts thus far:

1) The article actually admits that the District Attorney's Office was unable to prosecute this matter because it would be impossible to tell who put the images on the drive.

2) Roberts passed a lie detector test on the matter.

3) The suspect Macintosh G4 hard drive was a from a used computer used by other editors before Roberts.

4) The News-Press did not contact Roberts for a comment. Bias in the newsroom? At the very least, it is what The Indpendent Media Blog is calling "the biggest no-no in journalism".

5) As Roberts attorney pointed out, "You'd have to be working at it for three years to accumulate this much info". What he really means is who has that much hard drive space on a used G4?

Let's do the math. 15,000 images at let's say a megabyte each....that's 15 gigabytes of images on a used G4. A G4 that is maybe 6 years old shipped with a 27 gigabyte hard drive. A little more recent G4 powerbook would have shipped with a 60 gigabyte hard drive. Why would someone have more than half to a just under a third of their hard drive in images like this and think they could get away with it on a company computer? It would also severely affect performance....

Yes -- let's see what they come up with at Ampersand. But they better come up with a whole lot more. A few months ago I questioned whether they could get any lower. They have. There are no longer any journalists that are also management at De La Guerra Plaza. They've been trying to push this story for months even here at BlogaBarbara and I kept declining the comments. Are they doing this because no one else would? McCaw and Company should be ashamed of themselves....

News-Press Attacks Roberts

The Daily Sound has an early story on the reference in the News-Press today about supposed child pornography found on Jerry Robert's computer...from what I know about News-Press IT practices, however, it could have just as easily been planted by anyone. Opposing counsel only needs to ask if reporters had a login required for their work station -- my understanding unless one of you corrects me is that they did not. If this is the case, the night janitor could have put the files on his computer. If McCaw and Company have known about this hard drive for so long -- why the court action now? Their suit against Roberts is more than a few months old. I guess the hard drive recovery company didn't want to be in the middle of this kind of mess....
